About TCPA Demand Guide

TCPA Demand Guide exists because the people who receive TCPA demand letters almost never have a lawyer on retainer and almost always search the internet first. What they find is mostly written for consumers who want to sue, or for defence firms selling a retainer. Very little explains the position of the business that got the letter.

What it covers

The Telephone Consumer Protection Act, 47 U.S.C. § 227, the FCC rules that implement it at 47 C.F.R. § 64.1200, and the Florida Telephone Solicitation Act, Fla. Stat. § 501.059. Every page cites the provision it relies on so you or your lawyer can check it.

What it is built on

The content is the statute and the arithmetic, which are the same whoever sent your letter.

What it does not do

  • It does not rate, rank or review enforcement firms or law firms.
  • It does not give legal advice. A business facing a claim should speak to counsel licensed in its state.
  • It does not tell you to pay. It tells you how to work out the numbers and how to respond, which includes disputing items that fail on the evidence.

Corrections

Statutes and FCC rules change. If a page is out of date it is corrected once checked against the current text.
